Terms of Use (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you and Systemata Teknicum LLC governing your use of the TubTag mobile application and any associated services. By downloading, installing, or using TubTag, you agree to be bound by these terms.

1. License Grant

Systemata Teknicum LLC grants you a limited, non-exclusive, non-transferable, revocable license to use TubTag on Apple-branded devices you own or control, subject to the terms of this Agreement and the Apple App Store Terms of Service.

This license does not permit you to:

Copy, modify, or create derivative works of TubTag
Reverse engineer, decompile, or disassemble the application
Rent, lease, loan, sell, or sublicense the application
Remove or alter any proprietary notices or labels

2. Free Tier and Premium Subscription

TubTag is available in two tiers:

Free Tier: Limited to 6 tubs, 2 locations, and 1 photo per tub at no charge.
TubTag Premium: Unlimited tubs, unlimited locations, up to 4 photos per tub, and additional features. Premium is available for $19.99 USD per year.

Premium subscriptions purchased through the Apple App Store are subject to Apple's payment and refund policies. Subscriptions automatically renew at the end of each subscription period unless cancelled at least 24 hours before the renewal date through your Apple ID account settings.

3. Printer Bundle Redemption Codes

TubTag Premium may also be activated using a redemption code included with the purchase of a TubTag printer bundle. Redemption codes are subject to the following terms:

        Auto-Renewal: Subscriptions activated via redemption code automatically renew annually at the then-current redemption rate. Renewal charges are processed through the payment method associated with your original bundle purchase or as separately arranged. To cancel auto-renewal, contact us at support@tubtag.com before your renewal date.
    

Each redemption code is valid for one activation and one device at a time.
Codes may be re-entered on a new device to transfer an active subscription. The previous device loses Premium access immediately upon transfer.
Codes have no cash value and are not refundable except as required by applicable law.
Subscriptions activated via redemption code grant the same Premium features as App Store subscriptions for the duration of the subscription period.
An active internet connection is required to activate, transfer, and renew redemption code subscriptions.

4. Your Data

All tub records, photos, and location data created in TubTag are stored locally on your device. Systemata Teknicum LLC does not have access to your tub data. You are solely responsible for backing up your data. We are not liable for any loss of data resulting from device failure, app deletion, or any other cause.

The AirDrop export feature allows you to transfer your data between devices. Exported files are your responsibility once they leave the app.

5. Intellectual Property

TubTag, including its name, logo, design, and software, is the property of Systemata Teknicum LLC and is protected by applicable intellectual property laws. Nothing in this Agreement transfers any intellectual property rights to you.

6. Disclaimer of Warranties

TUBTAG IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SYSTEMATA TEKNICUM LLC DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Systemata Teknicum LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of goodwill, arising from your use of or inability to use TubTag, even if advised of the possibility of such damages.

Our total liability to you for any claims arising from this Agreement shall not exceed the amount you paid for TubTag in the twelve months preceding the claim.

8. Third-Party Terms

TubTag is distributed through the Apple App Store. Apple is not a party to this Agreement and has no obligation to provide support or maintenance for TubTag. In the event of any conflict between this Agreement and Apple's App Store Terms of Service, Apple's terms shall govern with respect to your use of the App Store.

Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce its terms against you.

9. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of TubTag and delete all copies from your devices.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Wyoming.

11. Changes to This Agreement

We reserve the right to modify this Agreement at any time. When we do, we will update the effective date at the top of this page. Your continued use of TubTag after any modification constitutes acceptance of the updated terms.
